NY judge: Unpaid interns can't sue for sexual harrassment

A New York district judge has ruled that unpaid interns cannot sue for sexual harassment because they are not technically employees, and therefore not covered by the New York Human Rights Law.

Lihuan Wang, 26, said that while she was an unpaid intern in 2010, her boss at Phoenix Satellite Television’s New York bureau invited her and other female interns to his hotel room under the guise of business — but then touched her inappropriately and tried to kiss her, according to the lawsuit.

"Protection of employees does not extend to unpaid interns,” Manhattan Federal Court Judge Kevin Castel wrote Oct. 3.
